This bill would allow state institutions of higher education to lower the class rank required for automatic admission to 7 percent until the percentage of the incoming class admitted under the top 10 percent law falls to 65 percent of total admissions. Enclosed is a proposal, which we think that you will benefit from. We are presenting a solution to the problem with the top 10 percent law. The way the law is now is definitely not fair to some Texas high school students. According to Elizabeth Aicklen, whom 60 Minutes interviewed and the many others whom we interviewed, say the top 10 percent is unfair. Aicklen went to Westlake, the most competitive public high in Austin. She received a 3.9 GPA, and still did not make the top 10 percent at her school. But 80 miles away in San Antonio, Laura Torres who attended Fox Tech, received a 3.4 GPA. With her GPA she easily made the top 10 percent. If Torres went to Westlake, she would have not even been in the top 50 percentile. Clearly this is not fair. Just because a student went to an easier high school or did not take any advanced placement classes to receive a GPA high enough to get them into the top 10 percent, does not justify them admissions to such a respectable university as UT. Another problem with the top 10 percent law is grades are inflated. With this inflation, more students are in the top 10 percent. And with more students in the top 10 percent, means that if that student picks UT as its number one college of choice, than the admissions has no choice but to accept that student. This uncontrollable admission process is leading to UTs overcrowding. Incoming freshmen classes are projecting to be made up of 72 percent top 10 percent students. This number takes away from the discretion UT has in choosing which applicants it will admit to the school and leaves hardly any room for the non-top 10 percent students or the out-of state students. This leads to three main problems. One, the increasing number of top 10 percent students coming to UT, which is leading to overcrowding, will increase the cost of running the university to accommodate more students. Which means raising the tuition once again, which will make the students unhappy. Two, the non-top 10 percent students, in fear that they will not get into UT because they are not in the top 10 percent, will apply out of state. With not changing this law, admissions could be forcing some of the brightest students out of Texas. Three, with so many top 10 percent students, admissions is not able to take as many out of state applicants. And clearly you do not want that to happen because out of state students means more money that they have to pay for tuition. CONDITIONS -Classes are overcrowded -Students are not graduating in 4 years -UT admission will not be able to handle incoming classes -More money needed for financial aid -Top students going to other schools -Only 2 top tier institutions for top ten percent students to choose from (UT and Texas A&M) -Hard to get classes you need because of high demand from too many students SOLUTIONS To fix these many problems, the top 10 percent law for automatic admission to any Texas college needs to be reduced to the top 7 percent. Therefore, only the top 7 percent of a graduating high school class in Texas will have guaranteed acceptance into the university of their choice. This past incoming freshmen class consisted of two thirds of the students getting in under the top 10 percent. This number is bound to go up if something is not done. If we changed the top 10 percent law to the top 7 percent, the number of students automatically entering UT under the law would reduce admissions to about half. The remaining spots would then go to the students whom the admissions believe possess the high enough qualifications to attend UT, just like any other state school in the U.S. does. BENEFITS The benefits of capping down the top 10 percent law are numerous. One benefit would be the flexibility to consider criteria other than class rank in its admissions decisions and the ability to control the number of students it admits, which it will be unable to do if the percentage of students admitted under top 10 percent continues to grow. With admission having the choice of who they want or do not want to be admitted to UT will give the university more well-rounded students. The way the law is now, test scores, strength of curriculum, essays, recommendations, activities, leadership, hardships overcome and athletic or artistic talent are all irrelevant. The law just looks at one thing: class rank. You said so yourself students are not one-dimensional and it would help to the university manage enrollment and diversity. Also by capping this law students will be encouraged to challenge themselves to take harder classes in high school instead of taking the easy way out. The way it works now, the students are taking easy classes and receiving As, to get into the top 10 percent. Which means that UT is not actually admitting the brightest students. According to the House Research Organization, students in the top 10 percent have SAT scores falling from 1253 to 1223 while non-top 10 percent SAT scores rising from 1197 to 1259. This is evidence that the quality of incoming students under the top 10 percent law is not as great has we thought. Another benefit would be that UT would not have the problem of overcrowding. By capping the top 10 percent law, admissions will not have to take everyone that wants to attend UT who is in the top ten percent. Meaning that they do not have to take as many students as they had to take in the previous years. This past year, 66 percent of the freshman class was in the top ten percent and fall 2005 it will be 72 percent. With this proposal there will be a huge benefit for the students at UT. Less people means class size will not be as large, it will be a lot easier to get your classes, making it possible to graduate in four years. Therefore there would be no need to make a set tuition, which you are enforcing next semester. And the biggest benefit to the biggest problem of the top 10 percent law would be that the admissions process would be fair. All students are applying under the same conditions. No one has the advantage or disadvantage. As a student, you would be evaluated as an individual and not be compared to your fellow students. CONCLUSION In conclusion, while we are certainly not trying to push toward a hasty decision regarding the top 10 percent law, we truly believe our proposal will do a great job in reducing the problems that the top 10 percent law embodies. We are merely trying to show up the students perspective on the top 10 percent law, and how we believe that it can be fixed by implementing the strategy found in our proposal.
